      Pre-Nuptual Agreement Broken in Omaha Court

      A long court fight was avoided today when the widow of the late John Appleby, signed a contract to relinguish (sic) her claim to one-fourth of his fortune to his daughter and two grand-daughters for the sum of $10,000, to be paid by the three heiresses.

      John Appleby, who at [illegible] married Raehel Williams, in June of 1921 had- allegedly entered into a pre-nuptual agreement with his bride that neither of them would make a claim for the other's estate alter one should die.

      Appleby, died in 1924 (sic*). He left all oi his property to his daughter, Emma J. Gaines of Elkhorn, and his two granddaughters, Pearl D.- Fry and- Gladys M. Gaines Doll, both living on farms near Elkhorn.

      When the will was admitted for probate in Douglas county court, Mrs. Appleby came into court and demanded her widow's one-fourth share. A compromise was finally struck by which Emma the daughter agreed to pay Mrs. Appleby, S8.000, and Gladys, the granddaughter, $2,000.

      Appleby left a fortune of $46,00Q in securities and 290 acres of Douglas county land valued at $160 above per acre.

      *As noted in John's obituary, he died in 1931, not 1924. However, every available news article about the widow's claim repeats the supposed 1924 death year.

      Emma Gaines Rites Are Set

      ELKHORN -- Services for Mrs. Emma Jean (Appleby) Gaines, 91, will be held at the Swanson Funeral Home chapel at Elkhorn at 2 p.m. Wednesday.

      Mrs. Gaines was born October 29, 1872, near Elk City.

      Survivors include two daughters, Mrs. Fred Doll of Elkhorn and Mrs. Robert Huff, Turin, Iowa; two granddaughters and three great-grandchildren.

      Officiating will be the Rev. W. 0. Samuelson. Frank Warren will be soloist with Mrs. Dean Sager as organist.

      Burial will be In the Elk City cemetery with the Swanson Funeral Home of Elkhorn in charge.

      ELKHORN--Services for Gladys M. Doll, 77, will be 2 p.m. Monday at the Swanson Funeral Home here. The Rev. Dr. Richard Linde will officiate. Mrs.

      Doll died Friday in an Omaha hospital.

      She was born Feb. 10, 1901, in Elkhorn.

      Her husband, Fred Doll, died Dec. 1, 1974.

      Survivors include a daughter, Mrs. Merlin (Beverlee) Dahnke of Elkhorn; sister, Mrs. Pearl Huff of Turin, Iowa; and 1 grandson.

      Burial will be in Elk City Cemetery.

      Visitation begins after 3 p.m. today.
