Charge to Be Filed Against Gondit Not Definitely Decided
Johnson County Attorney to Study Transcription Before Acting
"Charges definitely will be filed against Clark H. Condit." the Casper Tribune-Herald was informed Monday by A. T. Clark of Buffalo, prosecuting attorney of Johnson county. But he was not jet prepared to state whether he would charge second-degree murder or manslaughter, the county attorney added.
"I question if I will have the charge filed before Tuesday." he said. It was learned from Attorney Clark that Condit is being held in technical custody, but not confined in jail.
Member of one of the most prominent ranch families in northern Wyoming. Clark Condit is married and is the father of three children, it is reported. The widely known Condit ranch is located at Barnum, near the gateway to the notorious Hole-in-lhe-Wall country in southern Johnson county.
Thornley Smith, brother-in-law of Clark Condit, died last Friday in the Casper hospital. A coroner's jury here, after an inquest Saturday, returned a verdict that Smith had come to his death as the result of a knife wound inflicted bv Clark H. Condit. Witnesses testified that Smith and Condit had engaged in an altercation on New Year's day over the ownership of a cow and calf. This took place on the Rosenberger ranch two miles from Barnum, it was testified.
The injured man was brought to the Casper hospital by his wife, formerly Zoe Condit. who arose from a (turn to page 5)

sick bed to make the trip. She is i11 at the home of H. H. Patterson.
Mrs. Smith is the administratrix of the estate of the late H. H. Patterson the who passed away last spring. He was prominent in both ranch and Republican circles and was at one time a candidate for governor.
Although the inquest was held in Casper, since the deceased died here, further developments in the case and filing of charges will take place in Buffalo, Johnson county seat. Attorney Clark said he was awaiting a transcript of testimony given at the inquest, and the arrival of other papers, before going ahead with prosecution of a case against Condit.
